Defendant, arrested and brought before a justice of the peace charged with the offense of having one frog more than 150 frogs in his possession, pleaded guilty and then appealed on questions of law and fact to the district court, where he moved to withdraw the plea and enter a plea of not guilty. His motion was denied, oral testimony being heard. There was no trial de novo, but sentence was pronounced and judgment entered imposing a fine of $100 and costs and, in default of payment, confinement in the county jail for 90 days. Held:
