1. This matter comes for consideration upon the record in the trial court, the parties briefs and their oral argument before this court. Appellant James Henry appeals the decision of the County Court #1, Jefferson County, Ohio convicting him of one count of public indecency in violation of R.C. 2907.09(A)(3). The issues we must decide are: (1) whether Henry had a reasonable expectation of privacy when he was in an open area of a restroom at a public rest stop; (2) whether the police were required to obtain a warrant before placing video surveillance equipment in a public restroom; and, (3) whether all the elements of public indecency were established by sufficient evidence.
