1 Jeffrey G. Henschel appeals from a judgment of conviction for operating a motor vehicle while intoxicated, fourth offense, contrary to WIS. STAT.§ 346.63(1)(a), and operating a motor vehicle with a prohibited alcohol concentration, fourth offense, contrary to § 346.63(1)(b). Henschel contends that the circuit court erred when it concluded that his equal protection and due process rights were not violated by the multi-tiered prohibited alcohol concentration standard in the Wisconsin statutes. He further contends that error tainted the trial through improper hypothetical questioning of the States expert witness. We disagree with both contentions and affirm the judgment of conviction.
